These Terms and Conditions of Sale (“Terms”) govern travel services offered and sold by MOBEE INTERNATIONAL, including through www.mobeeinternational.com.

1. COMPANY INFORMATION

MOBEE INTERNATIONAL is a French simplified joint-stock company (SAS) with share capital of EUR 50,940, registered with the Villefranche-Tarare Trade and Companies Register under number 824 986 947.

MOBEE INTERNATIONAL is registered with the French Register of Travel and Stay Operators managed by Atout France under number IM069180010.

MOBEE INTERNATIONAL benefits from a financial guarantee provided by GROUPAMA Assurance-Crédit & Caution, 8-10 rue d'Astorg, 75008 Paris, France.

MOBEE INTERNATIONAL maintains professional liability insurance in accordance with the requirements applicable to travel operators.

Hereinafter referred to as “MOBEE INTERNATIONAL”, “we”, “us” or the “Agency”.

2. PURPOSE AND SCOPE

MOBEE INTERNATIONAL operates, in particular, as a Destination Management Company (DMC), designing, organizing and selling tailor-made travel experiences in France, Europe and, where applicable, other destinations.

Services may include:

  • accommodation;

  • transportation and transfers;

  • air and rail tickets;

  • excursions, visits and activities;

  • guide services;

  • vehicle rental;

  • meals and restaurant services;

  • event-related services;

  • concierge services;

  • assistance services;

  • any other travel service specified in the quotation or contract.

These Terms apply to bookings made directly with MOBEE INTERNATIONAL unless specific conditions are expressly stated in the quotation, commercial proposal or contract accepted by the Client.

Specific contractual terms shall prevail over these Terms in the event of any inconsistency.

3. QUOTATIONS AND PRE-CONTRACTUAL INFORMATION

Travel proposals, itineraries and quotations are prepared based on information supplied by the Client, including travel dates, number of travelers, destinations, budget, accommodation preferences, activities and any particular requirements.

Unless otherwise stated, a quotation does not constitute a confirmed booking.

Prices, availability and supplier conditions may change until the booking has been formally confirmed.

Before entering into the contract, MOBEE INTERNATIONAL provides the Client with the information required under applicable French travel law.

4. BOOKING AND FORMATION OF THE CONTRACT

A booking becomes binding once:

  1. the Client has accepted the quotation or proposal in writing;

  2. these Terms have been accepted; and

  3. the required deposit or payment has been received.

The written booking confirmation issued by MOBEE INTERNATIONAL constitutes confirmation of the contract.

Payment amounts and deadlines are stated in the quotation or booking confirmation.

Certain services, particularly transportation tickets, accommodation and activities sold under special rates, may require immediate payment and may be non-changeable or non-refundable.

5. PRICES

Prices are expressed in the currency stated in the quotation and include only the services specifically listed as included.

Unless expressly stated otherwise, prices do not include personal expenses, gratuities, non-included meals and drinks, passport or visa expenses, optional insurance, certain local taxes, independently booked activities or expenses resulting from Client-requested changes.

Prices are calculated on the basis of economic conditions known when the quotation is issued.

Where permitted by applicable law, prices may be revised due to changes affecting transportation costs, taxes or fees, or relevant exchange rates.

Any price adjustment shall comply with mandatory provisions of French travel law.

6. PAYMENT

Accepted payment methods are those offered to the Client when booking.

The Client warrants that they are authorized to use the selected payment method.

MOBEE INTERNATIONAL may suspend or cancel a booking if contractual payments are not received by the applicable deadlines.

Final travel documents may be withheld until all outstanding amounts have been paid.

7. CHANGES REQUESTED BY THE CLIENT

Requests for changes must be submitted in writing.

MOBEE INTERNATIONAL will use reasonable efforts to accommodate such requests, subject to availability and supplier conditions.

Changes may result in additional supplier costs, price differences, administrative fees or the loss of previously booked non-refundable services.

No change is confirmed until accepted in writing by MOBEE INTERNATIONAL.

8. CANCELLATION BY THE CLIENT

Specific cancellation terms contained in a quotation, proposal, booking confirmation or contract shall prevail.

Certain services may be fully non-refundable from the date of booking.

Where no specific cancellation terms have been agreed, the following cancellation fees apply:

  • more than 60 days before departure: 30% of the total price;

  • 60 to 31 days before departure: 50%;

  • 30 days or less before departure: 100%.

Any non-refundable amounts already committed to suppliers may in all cases be retained.

Cancellation requests must be submitted in writing.

9. CHANGES OR CANCELLATION BY MOBEE INTERNATIONAL

MOBEE INTERNATIONAL may need to modify travel arrangements where an originally planned service becomes unavailable or needs to be adapted.

Where an essential element of the contract is significantly changed, the Client shall benefit from the rights provided by applicable French travel law.

Where MOBEE INTERNATIONAL cancels a trip, the Client shall benefit from the refund and other rights provided by applicable law.

10. UNAVOIDABLE AND EXTRAORDINARY CIRCUMSTANCES

MOBEE INTERNATIONAL shall not be liable for consequences arising from unavoidable and extraordinary circumstances outside its or the relevant supplier's control.

These circumstances may include natural disasters, extreme weather, fires, epidemics, pandemics, armed conflicts, civil unrest, terrorist acts, governmental decisions, border closures, major transportation disruption or strikes.

Mandatory statutory rights of travelers remain unaffected.

11. TRANSPORTATION

Transportation services are also subject to the relevant carrier's contractual conditions.

Schedules, routes, aircraft, airports, stations and carriers may be changed by transportation providers independently of MOBEE INTERNATIONAL.

Nothing in these Terms affects rights travelers may have directly against carriers under national, European or international legislation.

12. ACCOMMODATION AND OTHER SUPPLIERS

Hotel and accommodation classifications are based on the official classifications or local practices applicable in the relevant destination.

Services may be provided by independent suppliers selected by MOBEE INTERNATIONAL.

Travelers must comply with supplier rules, schedules and safety instructions.

13. TRAVEL FORMALITIES

Each traveler is responsible for holding all documentation necessary for their journey, including where applicable a passport, identity card, visa, electronic travel authorization, health documents, documentation for minors and driving permits.

Travelers remain responsible for satisfying entry, transit and immigration requirements applicable to their individual circumstances.

14. HEALTH, MOBILITY AND SPECIAL REQUIREMENTS

Clients must notify MOBEE INTERNATIONAL before booking of any relevant special requirements, including accessibility requirements, reduced mobility, food allergies or other circumstances affecting the organization of the trip.

MOBEE INTERNATIONAL will use reasonable efforts to arrange suitable services based on information provided and supplier confirmations.

15. INSURANCE

MOBEE INTERNATIONAL recommends that travelers obtain suitable travel insurance covering, where appropriate, cancellation, interruption, medical assistance, repatriation, luggage and medical expenses abroad.

Where insurance is offered through MOBEE INTERNATIONAL, coverage is supplied by a separate insurer or intermediary and is subject to that provider's terms, limits and exclusions.

16. LIABILITY

MOBEE INTERNATIONAL is responsible for the performance of travel services included in a package to the extent required by the French Tourism Code.

Liability may be excluded or limited in circumstances permitted by applicable law, including where damage is attributable to the traveler, an unrelated third party, or unavoidable and extraordinary circumstances.

Applicable international conventions governing individual travel suppliers may also limit liability.

Nothing in these Terms limits any mandatory statutory right granted to a traveler.

17. INDEPENDENTLY BOOKED SERVICES

MOBEE INTERNATIONAL is not responsible for services booked directly by the Client or traveler from third parties and which do not form part of the contract with MOBEE INTERNATIONAL.

18. TRAVEL DOCUMENTS

Travel documents are generally supplied electronically.

Clients must check names, dates, schedules, routes and booked services immediately upon receipt and report any discrepancy without delay.

Costs arising from incorrect information initially supplied by the Client may remain the Client's responsibility.

19. NO STATUTORY COOLING-OFF RIGHT

Under applicable French consumer law, certain accommodation, transportation, catering and leisure services scheduled for a specific date or period are excluded from the general 14-day cooling-off right applying to many distance contracts.

Specific statutory rules governing travel packages remain applicable.

20. COMPLAINTS

Any issue encountered during the trip should be reported to MOBEE INTERNATIONAL as soon as possible so that an appropriate solution may be sought.

21. CONSUMER MEDIATION

Following a written complaint to MOBEE INTERNATIONAL, an eligible consumer who has not received a satisfactory response may refer the dispute free of charge to the consumer mediator appointed by MOBEE INTERNATIONAL.

22. PERSONAL DATA

MOBEE INTERNATIONAL processes personal data for enquiries, quotations, bookings and travel management.

23. INTELLECTUAL PROPERTY

Itineraries, programs, texts, graphic materials and other content created by MOBEE INTERNATIONAL are protected by applicable intellectual property rights and may not be commercially reproduced or exploited without prior authorization.

24. GOVERNING LAW

These Terms are governed by French law, without prejudice to any mandatory consumer protection provisions applicable under the laws of the consumer's country of residence.

Business-to-business disputes shall be subject to the competent courts determined under applicable law and any specific contractual arrangements.
